The Enactment of the Commission of Article 138 of the Constitution

Minister Members of workgroup of item (4) of enactment number 435818/T/116225 dated December, 8th 2006 in accordance to Article (79) of Electronic Commerce Law- ratified in 2003 – and according to the stated item number, ratified the executive Regulation of the National System of Product and Services Classification and Identification Services as following:
“Executive Regulation of the National System of Product and Services Classification and Identification Services”
Article 1- Subsequent terms are being used according to their related description in this Regulation.
- National System of Product and Services Classification and Identification Services:It is a system that controls the base information of the supply chain in the area of product and services and represent to various elements. By utilizing procedures and standards and specially the expert tools of Product and Services Classification and Coding, a common language and similar concepts has been created at the national level and the entire accredited product and services information such as the providers references, technical specification, national and international standards, etc., will be registered, stored and disseminated.
- National Classification Structure: The system is established upon a structure which has been created and made public by the Ministry of Commerce. This structure has classified product and services based on their nature and adapts to the condition of the country.
- Information Platform: The cyberspace is equipped with social memory and common concept which establishes multi-level information flow and facilitates electronic date exchange inside and outside of the organization. This platform would be placed as the infrastructure of the information base design so that the interaction ability increases between computer systems in different Organizations.
- Standards: It indicates the national standards of classification, name, and determining the identification of product at services which would be designed, defined, maintained and developed by the Ministry of Commerce.
- Base Information: There are two groups of information in all the supply chains. First group is the base information which is produced outside of the organizations and also is common among the entire elements of the supply chain. Second group is the operational information which are depended on the environment and mainly include statistics such as production measure, import basis, export basis, etc. The stated system will interact with base information and proceed with organizing, setting standard, producing, storing, and disseminating such information.
- National Information Portal of Product and Services: which would be named Information Portal in this Regulation, is an Internet Portal thru which the exchange of product and services base information throughout the supply chain (providers reference, name, national identification number, technical specifications, etc.) would take place and the product and services base Information would be organized and distributed via that in the appropriate information database modeling.
Article 2- The goal of this Regulation is the description of how to execute the system and to identify the general framework and the responsibilities of the executive system in that regard.
Article 3- The domain of this Regulation would include all the products, services, natural or legal persons, and their manufactures or providers. The manufacturing and provider institutions with legal person have priority in admittance.
Note 1: the retailers that directly provide the product and services to the end user are excluded from this regulation.
Article 4- Ministry of Commerce as the executive body of this system is bound within nine (9) months from the announcement of this Regulation to provide the structure of National Product Classification and the required standards to issue the national identification for all the products. The grace period for the services would be twelve (12) months following the announcement of this Regulation. The Management and Planning Organization (MPO) is responsible to provide the resources to execute the plan and all the related executed system, particularly the appointed system in the Regulation number H35818T/116225 dated December 8th, 2006 are responsible to cooperate in order to establish and expand this system.
Article 5- Ministry of Commerce is obligated to act upon preparing the educational and informational packages and by the cooperation of the concerned organization make the suitable informatics, acquaintance and general education through the mass media and other mediums in order to provide the appropriate platform to execute the system.
Article 6- All the conscripts of Article 3 of this Regulation are responsible to act with respect to the product classification and obtain national identification number within twelve (12) months and for services within eighteen (18) months after the time period becoming acquainted by contacting the authorized member companies listed in the Portal by the Ministry of Commerce, (Article 5).
By adopting essential measures, such as, incentive and protective mechanism, the Ministry of Commerce is responsible to make the necessary grounds for the membership of the applying natural and legal persons.
Article 7- The related Governmental Organizations are obligated to perform following:
- To execute the system, all the organizations are obligated to do their medium to large purchases with reference to the national identifier number beginning in 2009.
- To execute the system, the Ministry of Commerce is obligated within twenty four (24) months after the announcement of this Regulation, during the order registration, facility concession and export incentives, certificate issuance and Trade Card extension, to provide its services depending on the corresponding and certified national identifier presented thru the Portal by the applicant.
Also the stated Organizations in item 2 of the Enactment number H358185T/116225 dated December 8th, 2006 and other executive organizations are obligated in December of every year beginning in 2008, to announce to Ministry of Commerce the services list of the operation domain of every organization which would assist the development of the system, and provide the stated services depending upon presenting certified national identifier beginning of next year.
Article 8- Ministry of Commerce is obligated with the cooperation of the Custom Organization, Statistic Center, and Ministry of Industry and Mine of Islamic Republic of Iran and other concerned organizations to act upon in regards to provide the comparative table and create correspondence among National Product identifier with other existing coding system, such as ISIC, SITC, CPC, HS, etc.
Article 9- Once the concerned executive organizations require special credibility to make the system executable, they should anticipate their required annual credibility in their annual budgetary proposals to the Management and Planning organization.
Article 10- The required modification in this Regulation would be applied by presenting proposal from the related executive organization and their summation by Ministry of Commerce and the ratification in the editing workgroup of this same Regulation.
This enactment was approved by the President on April 20th, 2007.
